Terms of Service

These Terms of Service (the "Terms") are a public offer that governs your access to and use of Behappy Speak (the "Service"), operated by Individual Entrepreneur (FOP) Illya Lavrentyev, registered in Ukraine. By starting to use the Service or by subscribing to a paid plan, you accept these Terms in full. If you do not agree, please do not use the Service.

1. The Service

Behappy Speak is an AI-powered language-learning service delivered through a Telegram bot and Telegram Mini App. It lets you practise conversations, receive error analysis, and reinforce mistakes with exercises, currently for English and German.

The Service is a digital service provided electronically. There are no physical goods, no shipping and no delivery. Access is granted online through Telegram immediately after activation.

2. Eligibility and account

To use the Service you need a valid Telegram account and must be at least 16 years old (or the age of digital consent in your country). You are responsible for activity that takes place through your Telegram account.

3. Plans and subscriptions

The Service offers a free tier with 10 messages per day and a Premium subscription available with monthly or annual billing.

A paid subscription grants you access to the corresponding features for the paid period. Specific plans, limits and prices are shown on our website and inside the bot at the time of purchase.

4. Prices and currencies

Prices are displayed before purchase and may be charged in EUR or Telegram Stars, depending on the payment method. For card purchases, Creem acts as the seller and Merchant of Record and calculates, collects and remits applicable indirect taxes (see section 5).

We may change prices from time to time. Any price change applies only to future billing periods — it is not retroactive and does not affect the period you have already paid for. If a price changes before an automatic renewal, the new price applies from that renewal, and where required we will notify you in advance.

5. Payment and Merchant of Record

When you buy a subscription by card, the purchase transaction is governed by Creem's Buyer Terms, and the payment data you enter is processed by Creem under its Privacy Notice. Payments made with Telegram Stars are processed through Telegram. See our Privacy Policy for how payment-related data is handled.

6. Automatic renewal

Paid subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. On renewal, your chosen payment method is charged for the next period at the then-current price for your plan. By subscribing, you authorise these recurring charges until you cancel.

7. Cancellation

You can cancel your subscription at any time. Cancellation stops future renewals and further charges; it does not delete your account.

• For subscriptions paid by card through Creem, use the Creem Customer Portal available from your Behappy Speak profile, or contact us at elias@lavrentech.com and we will help.
• For Telegram Stars subscriptions, manage or cancel them through Telegram.

After you cancel, you keep access to paid features until the end of the period you have already paid for. When that period ends, your subscription reverts to the free tier. Refunds, if any, are governed by our Refund & Cancellation Policy.

8. Refunds

Refunds for this digital subscription are described in our Refund & Cancellation Policy, which forms part of these Terms. Approved card-payment refunds are processed through Creem and returned to the original payment method.

9. Digital content and start of service

Because the Service is digital content and access is provided immediately, you agree that performance begins as soon as your subscription is activated. To the extent permitted by applicable consumer law, once the digital service has been fully supplied and used, any statutory right to withdraw may no longer apply. This does not limit the remedies set out in our Refund & Cancellation Policy.

10. Acceptable use

You agree not to misuse the Service. In particular, you must not:

• use the Service for unlawful purposes or to submit illegal, harmful or abusive content;
• attempt to reverse engineer, copy, resell or commercially exploit the Service;
• use bots, scraping or automated means to abuse limits or disrupt the Service;
• infringe our or others' intellectual-property or other rights.

11. Intellectual property

The Service, including its software, content and branding, belongs to the Operator or its licensors. We grant you a limited, non-exclusive, non-transferable licence to use the Service for your personal, non-commercial learning while your subscription is active.

12. AI-generated content

The Service uses artificial intelligence to generate responses, corrections and exercises. AI output may contain errors or inaccuracies and is provided for language-learning purposes only. It is not professional, legal, medical or other expert advice.

13. Availability and changes to the Service

We aim to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. We may add, modify, suspend or discontinue features, and we may perform maintenance, at our discretion. Where a change materially reduces a paid feature you rely on, our Refund & Cancellation Policy applies.

14. Disclaimers and limitation of liability

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, the Operator's total liability arising from or related to the Service is limited to the amount you paid for the Service in the 12 months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

15. Suspension and termination

We may suspend or terminate your access if you materially breach these Terms or misuse the Service. You may stop using the Service and cancel your subscription at any time as described in section 7.

16. Governing law

These Terms are governed by the laws of Ukraine, without prejudice to any mandatory consumer-protection rights you may have in your country of residence.

17. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date shows the latest version. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
